Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Clarity Journal mobile application ("App", "Service"). By downloading or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

2. Description of Service

Clarity Journal is a personal journaling application that provides AI-assisted reflection prompts inspired by Jungian shadow work psychology. The App offers:

⚠️ Not a medical or therapeutic service. Clarity Journal is a self-reflection tool for personal growth and journaling. It is not a substitute for professional mental health care, psychotherapy, counselling, or medical advice. If you are experiencing a mental health crisis or need professional support, please contact a qualified healthcare professional or emergency service.

3. Eligibility

You must be at least 16 years old to use the App. By using the App, you represent that you meet this age requirement. If you are under 18, you should review these Terms with a parent or guardian.

4. Account and Data

Clarity Journal does not require account registration. Your journal entries are stored locally on your device. You are solely responsible for maintaining the security of your device and for all content you create within the App.

You may optionally enable App Lock (PIN or biometric) to protect your journal from unauthorised access. We cannot recover or reset an App Lock PIN as we do not have access to it.

5. Subscriptions and Payments

5.1 Free tier

The free version of the App provides one daily reflection, surface-level prompts, two shadow archetypes, and access to the last seven journal entries. The free tier is available indefinitely.

5.2 Pro subscription

The Pro subscription unlocks the full feature set including unlimited reflections, all prompt depths, all six archetypes, pattern detection, full history, weekly AI insights, app lock, journal export, and colour themes.

5.3 Billing

Pro subscriptions are offered on an annual basis and are processed by Google Play. Prices are displayed in the App at the time of purchase and are subject to your local currency and applicable taxes. By subscribing, you authorise the recurring charge shown in the App.

5.4 Refunds

Subscription payments are processed by Google Play. Refund requests must be submitted through Google Play's standard refund process at play.google.com/store/account/subscriptions. We have no ability to process refunds directly. Google Play's refund policy applies.

5.5 Price changes

We reserve the right to change subscription prices. If we change the price of your current subscription plan, we will provide reasonable notice. Continued use after the effective date of a price change constitutes acceptance.

7. Intellectual Property

All intellectual property in the App, including the software, design, prompts, archetype framework, and branding, is owned by or licensed to the Provider. Nothing in these Terms transfers any intellectual property rights to you.

Your journal entries are yours. We claim no ownership over content you write. However, you grant us a limited licence to process your journal entries using AI solely for the purpose of providing the Service to you (i.e. generating your analysis responses).

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or that AI-generated content will be accurate, complete, or appropriate for your individual situation. AI responses are generated automatically and may occasionally be incorrect or unsuitable.

9. Limitation of Liability

To the maximum extent permitted by applicable law, the Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the App, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising under or in connection with these Terms shall not exceed the amount you paid for the App or any subscription in the 12 months preceding the claim.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable German law (including §§ 305 et seq. BGB).

10. Privacy

Our Privacy Policy, available at clarity-journal.app/privacy (or the URL you publish this at), governs how we collect and use your data and forms part of these Terms.

11. Third-Party Services

The App uses third-party services including Google (Gemini API), RevenueCat, PostHog, and Google Play. Your use of the App is also subject to those services' terms and policies where applicable. We are not responsible for the acts or omissions of these third parties.

12. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the App at any time without notice. We will make reasonable efforts to maintain continuity of the Pro subscription features you have paid for.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via the App or our website. Continued use of the App after changes take effect constitutes your acceptance of the revised Terms.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Federal Republic of Germany, excluding conflict of law provisions and the UN Convention on Contracts for the International Sale of Goods (CISG).

For disputes with consumers within the EU, the European Commission provides an online dispute resolution platform available at ec.europa.eu/consumers/odr. Our email address for this purpose is: strehldevs@gmail.com. We are not obligated to participate in alternative dispute resolution proceedings but will consider them on a case-by-case basis.

If you are a consumer resident in Germany, any mandatory consumer protection provisions of German law that provide you with more favourable rights shall apply regardless of the chosen law.

These Terms were written in English. In the event of a conflict between this English version and any translated version, the English version shall prevail. Consumers in Germany may rely on mandatory German consumer protection law where applicable.
